The investor’s country of origin has to have a treaty of commerce and navigation with the United States. To find out whether your country is part of the US treaty country, check the list here.

2. The investor must have invested or be in the process of investing a substantial amount of capital in a new or existing US business

There is no set amount of capital required by the USCIS, but the investment must be significant enough to show that the investor is committed to the success of the business.

3. The investor must also demonstrate that they will be actively involved in the management of the business.

This means that the investor must have a full control in the business or hold a key executive position. They must also show that the business will generate more than just enough income to support the investor and their family.
